RE: Proposed Amendments to the Zoning Ordinance

Attached hereto, please find proposed Amendments to the Zoning Ordinance
of the Town of Wappinger, which were referred to you by the Town Board, following
their last Workshop.
The Town Board would like your recommendations with respect to these
matters, and upon receipt of same, will schedule a Public Hearing regarding these
matters.
In accordance with Section 602 of the present Zoning Ordinance, your recommendation
is necessary prior to the Town Board adopting the Ordinance. If you do not recommend
these additions, it would then require a two -third (2/3) vote of the Town Board in
order to adopt them.
The copy enclosed includes not only the proposed text of the two sections,
but also the Notice of Public Hearing which will be scheduled by the Town Board.
The first Amendment, Section 711 would allow fees to be set by the Town
Board by Resolution. The Chairman of the Planning Board has already made a recommendation
to the Town Board with respect to the amounts of fees which should be charged,
and those fees are the ones that the Town Board would anticipate adopting following
the amendment to the Ordinance.
The second Amendment would appoint the Zoning Administrator as the Clerk
of both the Zoning Board and Planning Board: This would enable the Zoning Administrator
then to receive service of process on behalf of both boards and also would be the
certifying agent for any certified copies of Resolutions, etc. and no Resolution would
be effective until filed with the Clerk.
If you have any questions or wish to discuss this matter with me, I would
be very happy to attend a Workshop session with you:
