My dear Mrs. Snowden:
The question you asked on behalf of our Honor-
able Town Board in your letter of February 19, 1971,
is so general as to be hard to interuret.
Perhans the Board had reference to Section 1219
of the Vehicle and Traffic Law which reads:
"(a) no person shall throw or denosit upon
any highway any glass bottle, glass,
nails, tacks, wire, cans, snow or any
other substance likely to injure any
person, animal, or vehicle upon such
highway.
(b) Any person who drops, or permits to be
dropned or thrown, upon any highway any
destructive or injurious material or any
material which interferes with the safe
use of the highway shall immediately re-
move the same or cause it to be removed.
(c) Any nerson removing a W1recked or damaged
vehicle from a highway shall remove any
glass or other injurious substance dropped
upon the highway from such vehicle. "
or to Section 1220:
(a) "No person shall throw, dump, denosit or
nlace or cause to be thrown, dumped de-
posited or placed unon any highway, or
unon nrivate lands adjacent thereto, any
refuse, trash, garbage, rubbish, litter
or any nauseous or offensive matter.

(b) Nothing herein contained shall be con-
strued as prohibiting the use in a
reasone.ble manner of ashes, sand, sal t
or other material for the purpose of
'reducing the hazard of, or providing
traction on snow, ice or s] eet. !!
I am honored and flattered by the inquiry on
behalf of the Board, but am obliged to ooint out that
not being an attorney, I am prohibited by law from
rendering legal opinions in cases such as this. May
I respectfully suggest that the Attorney to the TO\-Tn
is eminently qualified and legally free to offer such
advice. I am, of course, available for whstever helo
I might be in answering any questions or giving any
informal assistance anyone in Town government might
seek in connection with their official duties or for
any consultation Town officials might require.
