Notary Public NatarY State Nes�d!r9 i:utclre7a �auary March 'A 187 % r ,EGAL NOTICE NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that the Town Board of the Town of Wappinger will hold a Public Hearing at the Town Hall, Mill Street, Wappingers Falls, New York, at ;7:30 P.M. on the 15th day of January, 1975, to hear all persons regarding the adoption of the following: AN ORDINANCE EXTENDING TIE PERIOD OF TIME WITH REGARD TO THE APPROVAL OF PLATS AND SITE PLAN APPROVALS BY THE PLANNING BOARD The following Ordinance was introduced by Councilman Versace who moved its adoption WHEREAS the Town Board did adopt an Ordinance on September 19th, 1974, regarding the withholding of site plan approvals and subdivision plats by the Town Planning Board and WHEREAS, the Town Board, the Town Planning Board and Zoning - Advisory Commission are in the process of reviewing and studying the new Zoning Ordinance, NOW THEREFORE BE IT ORDAINED as follows: 1. That the Ordinance adopted by the Town Board on September 19th, 1974, be affirmed and continued for an( additional 60 days beyond its effective date so as to provide the Town.Board and the Town Planning Board additional time to prepare a new comprehensive Zoning Ordinance. Said Ordinance providing for said moratorium is more fully set forth at pages 313 and 314 of t -he minute book of the Town Clerk for the period commencing June 10th, 1974 reference to which is hereby made. 2. The Dutchess County Department of Planning, therefore, recommends the decision be based upon local study of the facts in the case. The Dutchess County Department of Planning does not presume to base its decision on the legalities or illegalities of the facts or procedures enumerated in subject zoning action. Whereas the 120 day moratorium on subdivision and site plan approvals has almost reached its conclusion and work on the proposed zoning ordinance is not complete and is not expected to be completed within sixty (60) days, the Planning Board does not support an extension of the moratorium but would rather suggest a return to a situation whereby building and subdivisions are not prevented from occurring within the next building season and that the existing Town of Wappinger Zoning Ordinance should be used in the interim as the Zoning Ordinance Committee continues its work until the proposed zoning ordinance is a fait accompli and is ready for presentation to the Town Board.
