I support your letter of February 19, 2002, on the above referenced subject.
However, I would like to add some comments, which consist primarily of itemizing
issues which I hope will not be overlooked during the upgrading of said Ordinance.
They are as follows:
• Distinct differentiation between stationary Vendors and holders of Temporary
Sales Permits
• The issue of Veterans and any exemptions/privileges they might be entitled to
• Clear, uncomplicated Permit Application procedures, perhaps even including a
process for "special circumstances"
• Precise steps for efficient Enforcement

In view of complaints about the locations of current "stationary" hot-dog vendors I have
reviewed Section 175 and have found that 5(B) of said section states that applicants are
required to receive a Special Permit, in accordance with Section 240, Zoning, prior to
receiving the Hawking and Peddling license from the Town. This seems not to have been
done in many years, if ever.
Further review put me into a quandary. Consider the following:
Section 240-43E, Zoning, states that Site Plan approval ....is required for all Special
Permit uses. In view of the fact that the vendors must conduct their business in areas
"legally open to public use, such as public streets, sidewalks, roadways, highways,
parkways, alleys, and any other public way," how can one prepare a site plan?
Section 240-43.B.(2), states that "where the Town Board is the approving agency, the
application shall be referred to the Planning Board for its review and
recommendation."
• Section 240-49, states that "when the Town Board is ....... the approving agency, it
need only give consideration to and generallybe guided by the .......standards and
requirements."
Of the present licenses holders, three are "stationary" peddlers/vendors. Not one of them
is in compliance with the requirements of Section 175-12, which spells out the
restrictions on locations and distances. Yet they have been issued permits regularly.
I have already written to all of them and have included copies of Section 175.
One vendor's license recently expired. She has already come in for a renewal and is now
understandably confused by the news that she is not in compliance. I feel that, at present,
it is not right to begin a crack -down without giving the vendors the necessary time to
bring things into compliance. But it is necessary to pinpoint just what will constitute such
compliance.
I ask the Town Board to address this issue, perhaps at a Workshop, so that both the Town
and the applicants are clear as to both the procedures and the requirements involved in
this licensing process.

Gentlemen:
Each year as Spring arrives, so do the hordes of
solicitors for various enterprises descend upon our
Town. These people travel in groups, in many cases
attempt to sell inferior or non-existent merchandise,
create problems for the homeowner in that they will not
take "no" for an answer, and also at times have brought
fear to the hearts of housewives.
May we suggest that this Town adopt an ordinance
providing for the identity and licensing of peddlers
itinerant vendors and the like so that there will be
records and controls on this activity. It is our rec-
ollection that such legislation was under consideration
by your board in 1969, but to the best of our knowledge,
no local low was established.
May we call to your attention that there are local
laws of this nature in effect in some of our surrounding
townships and that the Office of Local Government is in
a position to provide a model piece of legislation if such
is your desire.

Re: Regulation of Peddlers
Dear Hon. Members of the Town Board:

At the last meeting of the Town Board, a
question was raised as to what regulations may
be imposed upon hawkers and peddlers.
The town may not prohibit hawkers and
peddlers unless it is necessary for the
preservation of the public health, safety,
morals, or peace or for the promotion of the
general welfare of the community. In the
absence of a substantial outcry from the
residents of the town with respect to the activi-
ties of hawkers and peddlers within the town,
I suspect that these preconditions do not exist.
However, the town may, through its powers
under section 131 of the town law, regulate
peddlers and require their licensing as a pre-
condition for activities within the town. These
regulations must be reasonable and may not be
such as to discourage altogether activities of
this nature. However, the courts oDnstrue this
to permit the prohibition of solicitation or
peddling upon private property without prior
invitation.

Our ordinance contains only one regulatory
provision with respect to hawkers and peddlers,
namely, that they may not undertake their activities
without first obtaining a license. The Board may
want to consider further regulation such as regu-
lating the time and place of such activities.
