The Dutchess County Department of Planning has reviewed subject referral
within the framework of General Municipal Law (Article 12B, Sections 239-1 and
239-m) and finds the decision in this matter primarily involves matters of
local concern.
The Dutchess County Department of Planning, therefore, recommends the decision
be based upon local study of the facts in the case.
The Dutchess County Department of Planning does not presume to base its
decision on the legalities or illegalities of the facts or procedures
enumerated in subject zoning action.

NOTICE IS HEREBY GIVEN, pursuant to Section 264 of the
Town Law, that a Public Hearing will be held by the Town Board
of the Town of Wappinger on Monday, April 16th, 1984 at 7:30 P.M.
at the Town Hall, Mill Street, Village of Wappingers Falls, New
York, on an Ordinance Amending the Zoning Ordinance on Section
421 (e) "Setbacks", copy of which is herewith enclosed.

RESOLUTION SETTING UP A PUBLIC
HEARING ON PROPOSED AMENDMENT
TO THE ZONING ORDINANCE OF THE
TOWN OF WAPPINGER
WHEREAS, the Town Board of the Town of Wappinger,
County of Dutchess, State of New York, has decided to hold
a public hearing regarding the amendment of Article IV,
District Regulations, Section 421(e), Schedule A, entitled,
"Schedule of Regulations for Residential Districts", by deleting
certain words from the said schedule of regulations, to wit:
the words, "front yard" are to be deleted so that said section
shall now read as follows: "setbacks on County and State roads
shall be a minimum of seventy-five (75) feet."; now, therefore,
be it
RESOLVED, that in accordance with the provisions of
Section 264 of the Town Law of the State of New York, a Public
Hearing be held on the day of April, 1984 at 7:30 P.M.
at the Town of Wappinger Town Hall, Mill Street, Wappingers
Falls, New York. All interested persons shall have an opportunity
to be heard at the meeting on the question of whether the Zoning
Ordinance shall be amended; and it is further
RESOLVED, that the notice of the time and place of the
Hearing shall be published at least ten (10) days before the time
and date of the Hearing in the
which is a newspaper of general circulation in the Town of
Wappinger.

Dear Members of the Board:
This letter is written to advise that we concur with the February 22, 1984 letter
of request from the Planning Board to amend the Zoning Ordinance, Section 421,
Schedule item E, regarding front yard setbacks on County & State roads.
We agree with the Planning Board's recommendation to change footnote, item E, to
read setbacks being 75' off, thus eliminating the word "front yard

Dear Board Members;
February 22, 1984
The Town of Wappinger Planning Board would like to suggest a
change in the wording of the Zoning Ordinance, due to a recent problem
raised regarding setback requirements on state and county roads.
The Zoning Ordinance currently reads, "Frontyard setbacks on
county and state roads shall be a minimum of 75 feet." (Note f., Sect.421)
The Board suggests omitting the word "frontyard" as developers are
simply changing the direction the house/'building faces to avoid the
75 foot requirement. Changing the Ordinance to read simply, "Setback"
would alleviate this problem.
