Re: LB (Local Business) Zoning Districts
The Dutchess County Department of Planning has reviewed subject referral
within the framework of General Municipal Law (Article 12B, Sections 239-1 and
239-m) and finds the decision in this matter primarily involves matters of
local concern.
The Dutchess County Department of Planning, therefore, recommends the decision
be based upon local study of the facts in the case.
The Dutchess County Department of Planning does not presume to base its
decision on the legalities or illegalities of the facts or procedures
enumerated in subject zoning action.

PLEASE TAKE NOTICE that the Town Board of the Town of
Wappinger will conduct a Public Hearing at the Town Hall, Mill
Street, Wappingers Falls, New York on April 12, 1982 at 7:55 P.M.
EST on an Ordinance Amending the Zoning Map of the Town of
Wappinger (LB, Local Busines to NB, Neighborhood Business,
as follows:
WHEREAS, the Town Board of the Town of Wappinger adopted
a Zoning Ordinance and Zoning Map on March 10, 1980, which
Ordinance and Map has been amended from time to time and,
WHEREAS a certain district appearing on such Zoning Map
as "LB" (Local Business) was mistakenly designated as such
with no provision being made in the Zoning Ordinance for
"LB" zoning, and
WHEREAS, it was the intent of the Town Board to designate
such area as "NB" (Neighborhood Business) and
WHEREAS, the Town Board wishes to correct such mistake,
BE IT ORDAINED by the Town Board of the Town of Wappinger
as follows:
Section 1. All those districts appearing on the Zoning Map
dated March 10, 1980, as amended from time to ti:e, as "LB" shall
hereinafter be designated as "NB" (Neighborhood Business) zones
on such map.
Section II. This amendment shall become effective upon
adoption, posting and publication, as prescribed by Town Law.

The following Resolution was introduced by Councilman
who moved its adoption:
BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger,
Dutchess County, New York, in pursuance to the authority conferred by the
Laws of the State of New York, that the Zoning Map of the Town of Wappinger
as adopted on March 10, 1980, and as amended foom time to time is hereby
further amended as follows:
Section I. Due to an apparent misprint on the Town of Wappinger Zoning
Map, a certain described parcel has been designated'LB" (Local Business),
which is no longer an applicable Zoning classification, the following described
property now designated as LB (Local Business) on the Zoning Map of the Town
of Wappinger is hereby rezoned to the designation of NB (Neighborhood Business):
ALL that tract or parcel of land described on the tax map of the Town of
Wappinger as Grid Number 19-6056-01-048548-00. Said premises are located on
the southerly side of Chelsea Road in the Town of Wappinger, Dutchess County,
New York and are generally know as 5 Broadway, Chelsea, New York.
SECTION II. This ordinance shall take effect immediately upon adoption,
posting and publication, as provided by Town Law.

amended as follows:
SECTION 1: The following described property now designated
RD -20 on the zoning map of the Town of Wappinger is hereby rezon-
ed to the designation of Local Business %1. (LB):
ALL that tract or parcel of land described on
the tax map of the Town of Wappinger as Grid Number 19-6056-01-
048-548-00. Said premises are located on the southerly side of
Chelsea Road in the Town of Wappinger, Dutchess County, New York
and are generally known as 5 Broadway, Chelsea, New York.
SECTION 2: This Ordinance shall take effect immediately
upon adoption, posting and publication, as provided by Town Law.
