The meeting was called to order by Supervisor Diehl_, and upon

The following resolution was offered by Councilman _ Johnson

BOND RESOLUTION DATED FEBRUARY 14 , 19.83.
A RESOLUTION AUTHCRIZING THE CONSTRUCTION OF A DEPENDENT
ADDITION TO THE HIGHWAY GARAGE IN AND FOR THE TOWN OF WAPPINGER,
DUTCHESS CCUNTY, NEW YORK, AT A KAXIKUK ESTIMATED COST OF
$49,950, AND AUTHCRIZING THE ISSUANCE OF $47,450 SERIAL BONDS
AND $2,500 CAPITAL NOTES OF SAID TOWN TO PAY THE COST THEREOF.
BE IT RESOLVED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section _1. The reconstruction of a dependent addition to the
highway garage in and for the Town of Wappinger, Dutchess County,
New York, at a maximum estimated cost cf $49,950, is hereby
authorized.
2ecti2n_2_ The maximum estimated cost of such specific object 'or
purpose is $49,950, and the plan for the financing thereof is as
follows:
a) By the issuance cf $47,450 serial bonds cf said Town,
hereby authorized to be issued pursuant to the Local
Finance Law; and
b) By the issuance of $2,500 capital notes cf said Town hereby
authorized to be issued pursuant to the local Finance Law.
Such capital notes shall be sold at private sale and all
further powers in connection with the details and the sale
thereof are 'hereby delegated to the Supervisor, the chief
fiscal officer, in accordance with. the Local Finance Law.
Pursuant to Section 107.00 of the Local Finance Lau, the
proceeds from the sale of such capital notes will be
provided prior to the issuance cf the bonds herein

authorized or bond anticipation notes. Said capital notes
1r. shall constitute the down payment required by Section
107.00 of the Local Finance Law.
Section ? It is hereby determined that the period of probable
usefulness of the aforesaid specific object or purpose is twenty
years, pursuant to subdivision 12(a)(1) of paragraph a of Section
11.00 of the Local Finance Law. It is hereby further determined
that the maximum maturity of the serial bonds herein authorized rill
exceed five years. It is hereby further determined that no other
capital improvements have been made to the Town highway garage
during the fiscal year commencing January 1, 1983.
2eg1jon__4_ Subject to the provisions of the Local Finance Zaw,
the power to authorize the issuance of and to sell bond antics: atioh
notes in anticipation of the issuance and sale of the serial bonds
herein authorized, including renewals of such notes, is hereby
delegated to the Supervisor, the chief fiscal officer. Such notes
shall be of such terms, form and contents, and shall be sold in such
manner, as may be prescribed by said Supervisor, consistent with the
provisions of the Local Finance Law.
Section 5. The faith and credit of said Town of Wappinger,
Dutchess County, New York, are hereby irrevocably pledged to the
payment of the principal of and interest on such obligations as the
same respectively become due and payable. An annual appropriation
shall be made in each Year sufficient to pay the principal of and.
interest on such obligations becoming due and payable in such year.

Section 6. The validity of such bonds, bond anticipation notes
and capital notes may be contested only if:
1) Such obligations are authorized for an object or purpose
for which said Town is not authorized to expend money, or
2) The provisions of law which should be complied with at the
date of publication of this resolution are not
substantially complied with,
and an action, suit or proceeding contesting such validity is
ccnrenced within twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the
provisions of the Constitution.
Section 7. Upon this resolution taking effect, the same shall be
published in full in &_3_n.News , the official
newspaper, together with a notice of the Town Clerk in substantially
the form provided in Section 81.00 of the Local Finance law.
Section Q. This resolution is adapted subject to permissive
referendum in accordance with Section 35.00 of the Local Finance Law.

the meeting of the Town Board of said Town, including the
resolution contained therein, held cn the 14th day cf February,

the same is a true and correct transcript therefrom and of the
whole of said original so far as the same relates to the
subject matters therein referred to.
