February 27, 1976 Town Board Town of Wappinger Wappingers Falls, N.Y. Gentlemen: The attached tables indicate the extent of the activity in Town Court, over which I presided, in the calendar year of 1975. Again, I must point out the inadequate facilities provided for this arm of town government. For those with an arithmetical bent, Table II will quickly show an average of thirty two cases disposed of per week. This, gentlemen, is cases, and it does not consider that many cases require more than one court appear- ance. If we suppose that only two persons appear per case, you can readily see that on the average over sixty persons per week appear. You know the facilities. Can you picture sixty persons contained therein ~ Of Course, not, and therein lies one aspect of our problem. Should any of several possible situations arise and someone is injured, I dare say that the Town faces the pros- pect of a liability suit. Its success, of course, depends on many factors. As you know, we have been advised by the Fire Inspector of the Village of Wappingers Falls, Mr. Phil Galioto, that we are violating the statutes governing places of public assembly. With these concepts in mind, may I strongly urge rapid ac- quisition of better physical facilities for our Town Court. I am aware that twice negotiations for space have been en- tered into and have fallen through. May I suggest that the follow- ing procedures be adopted in future negotiations: (a) deal only with principals with the power to make committments; (b) when a meeting of minds has been reached, immediately reduce the terms to writing and have them signed by both parties; (c) complete . .,. *" JUSTICE COURT TOWN OF WAPPINGER ~ , o~ VJ~Pp ~~,,'~'~',';~';.\~~~<'~~G', o / ,r,." You will note from Table II that there has been an in- crease in total cases, further aggravating the space problem. I again invite your personal visits to assess this prdblem. I have read in the public press that your Board is considering the problems of police protection in Wappinger. May I suggest that the upper ranks of the New York State Police be contacted, since I understand they now have a policy of contracting with municipalities for increased services. Re- cently, such contracts have been agreed to at Hunter, N.Y (Leeds Barracks) and Pound Ridge, N.Y. (Somers Barracks). Such a con- tract might provide the solutions you seek at a reasonable cost to the taxpayers. A review of Table III will show that I have submitted to the Comptroller of the State of New York a total of $18768.20 in various forms of court income. As nearly as can be determined, because of inadequate reports, only a small portion of these funds are returned to the Town. I am attempting to determine exactly what amounts are actually returned, and if all funds to which the Town is entitled, are in truth, being received. I shall keep you advised of progress in this matter. In turn, you might take any steps advisable to bring about an increase in the fees paid to the Town for its service, by the State of New York. Please be assured of my continued cooperation with all govern- mental units within the Town.
