January 9, 2006 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York.

RESOLUTION ADOPTING RULES OF THE TOWN BOARD OF THE TOWN OF
WAPPINGER
The following Resolution was introduced by Councilwoman McCarthy and seconded by

WHEREAS, to ensure the orderly conduct of Town Board business, the Town Board
wishes to adopt a set of rules governing the Town Board.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby adopts the "Rules
of the Town Board of the Town of Wappinger," in the form annexed hereto, as the
governing rules of the Town Board.

BE IT RESOLVED, that the Regular Monthly meeting of the Town Board of the Town of
Wappinger shall be held at 7:30 p.m. at the Town Hall, 20 Middlebush Road, in the To -
of Wappinger, Dutchess County, New York, in the evening of the 4th Monday of each
month, or at such other place or places within the Town of Wappinger as the Town Board
shall from time to time designate.

RESOLUTION DESIGNATING AN OFFICIAL NEWSPAPER
FOR THE TOWN OF WAPPINGER
The following Resolution was introduced by Councilwoman McCarthy and seconded by
Councilman Bettina.
BE IT RESOLVED, that the Southern Dutchess News, a newspaper regularly published
in the Town of Wappinger, Dutchess County, New York and having a general circulation
in this Town, and being a newspaper entered as second class main matter, be and the
same hereby is designated as the official paper of the Town, and
BE IT FURTHER RESOLVED, that the Poughkeepsie Journal, published in the County
of Dutchess and having general circulation therein, be and is designated as an additional
newspaper for the publication of Town Notices, subject to the limitations of Section 64,
Subdivision 11 of the Town Law of the State of New York, and
BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby is authorized and
directed to give notice of such designation to the publishers of such newspapers.

RESOLUTION EMPLOYING LEGAL SERVICES FOR THE TOWN OF WAPPINGER
The following Resolution was introduced by Councilwoman McCarthy and seconded by
Councilman Bettina.
BE IT RESOLVED, that Albert Roberts be and he hereby is employed and retained for the purpose
of furnishing to the Town Board, its officers and Agencies, such legal advice and services as may be
required and he shall receive compensation therefore in accordance with a proposal to this board, and
BE IT FURTHER RESOLVED, that Emanuel Saris be and he hereby is employed and retained for
the purpose of furnishing to the Town Board, its officers and agencies, such legal advice and services
as may be required for representing and defending the Town of Wappinger for all Article 78 Tax
Certioraris as may be filed against the Town in the year 2006, and he shall receive compensation
therefore in accordance with a proposal to this board, and
BE IT FURTHER RESOLVED, that Marco Caviglia be and he hereby is appointed special counsel
for the Zoning Board and their meetings, and Code Enforcement.

schedule the days and evening such individuals shall serve as Court Officers, and
BE IT FURTHER RESOLVED, that Jason Morse is hereby designated an unarmed
Court Officer, and

Court Officer, and

BE IT RESOLVED, that Ralph Holt, Chairman of the Recreation Committee, be and he
hereby is appointed to serve as the Consultant to the Town of Wappinger Recreation
Committee, and
BE IT FURTHER RESOLVED, that the annual salary for the Consultant to the
Recreation Committee of the Town of Wappinger be and the same hereby is fixed and
established at the annual rate of $ 14,000.00 to be paid every Friday throughout the year
with the first payday to be January 6, 2006.

Registrar of Vital Statistics to the town of Wappinger, Dutchess County, New York, for a
term of two years commencing January 18t, 2006 and ending December 31st, 2007,
pursuant to Section 4123, Public Health Law, and
BE IT FURTHER RESOLVED, that said Registrar of Vital Statistics to the Town of
Wappinger shall receive no salary or compensation, however, he shall be entitled to
receive for the performance of the duties of this respective office the fees fixed by
applicable statute.

Town of Wappinger, pursuant to Article 3 Section 11c of the Domestic Relations Law, to
serve at the pleasure of the Town Board, and
BE IT FURTHER RESOLVED, that Cheryl Hait shall not receive a salary for said
position, however, she may accept gratuities up to $75.00 per ceremony at which she
officiates.

WHEREAS, the Town Board has established a salary scale system based on pay grade and steps for town
employees, and

WHEREAS, the Justice Court has had an increase in its work load and has the need of
having to make change on a daily basis, and
WHEREAS, the Town Clerk of the Town of Wappinger has numerous requests for
expenditures of small amounts of cash for postage, supplies, making change on a daily
basis, and various miscellaneous items, for various departments of the Town of
Wappinger, and
WHEREAS, a Petty Cash fund has been established for the Receiver of Taxes, pursuant
to the provision of Section 64, paragraph 1-a of Town Law, which shall be reimbursed to
the Supervisor for advances at the close of each fiscal year, and
WHEREAS, the Recreation Committee has numerous request for expenditures of small
amounts of cash for supplies and miscellaneous items and reimbursement of small
expenditures to various areas of the Recreation program and Maintenance work for the
Town of Wappinger,
NOW THEREFORE BE IT RESOLVED, that the Town Justice Court, the Town Clerk,
and the Receiver of Taxes are hereby authorized and directed to establish a Petty Cash
Fund, in the sum of $200 each, for the use of said Justice Court, Town Clerk, and
Receiver of Taxes, and the sum of $100 for the use of the Recreation Committee, as
provided by Paragraph 1-a of Section 64 of Town Law.

WHEREAS, pursuant to Town Law, a Budget is prepared each year by the Supervisor
detailing expenses and revenues for the ensuing year, and
WHEREAS, the Town Board shall review said tentative budget and reject or modify any
budgetary item as they deem appropriate, and
WHEREAS, that after due process of Public Hearing and provision for additional
amendments, the annual Budget shall be adopted,
NOW THEREFORE BE IT RESOLVED, that within the confines of section 117 of the
Town Law where provisions have been made in the annual budget for specific, large
expenditures, further approval by the Town Board to consider the purchase of those
expenditure need not be sought, provided that no other part of the Town's procuremen
Policy is circumvented, and

WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the Supervisor of
each Town prepare and file with the Town Clerk within 30 days after the expiration of
each fiscal year an annual financial report accounting for all monies received and
disbursed by him, together with the certificates or certificate of the bank or trust
company where Town monies are deposited, showing the amount of such monies on
deposit with said bank or trust company, and cause a certified copy of such report to be
published in the official newspaper, and
WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of
Town Law, the Town Board may determine, by resolution, that the Supervisor shall
submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the
report to the State Comptroller required by Section 30 of the General Municipal Law
and the Town Clerk shall cause a summary of such report to be published within 10 days
after receipt thereof in a form approved by the State Comptroller in the official
newspaper.

The following Resolution was introduced by Councilwoman McCarthy and seconded by

WHEREAS, the Town Board of the Town of Wappinger has determined that it is in the
best interest of the Town to amend §234-44.A of the Town of Wappinger Code to permit
water rate changes to be adopted by Local Law as well as to establish the water rate
structure for the Central Water System for the 2006 calendar year based on the budget
adopted by the Town Board; and
WHEREAS, the Notice of Public Hearing was duly advertised in the Southern Dutchess
News, the official newspaper of the Town and the Poughkeepsie Journal; and
WHEREAS, the Public Hearing was held on January 9, 2006 and all parties in
attendance were permitted an opportunity to speak on behalf of or in opposition to said
proposed Local Law or any part thereof, and
WHEREAS, the Town Board determined that the proposed Local Law was not subject to
Environmental Review; and

WHEREAS, said proposed Local Law has been on the desks of the members of the Town
Board of the Town of Wappinger for at least seven (7) days exclusive of Sunday, prior to

RESOLUTION ADOPTING SEWER RENT STRUCTURE FOR SEWER DISTRICTS
AND SEWER IMPROVEMENTS FOR THE 2006 CALENDAR YEAR
The following Resolution was introduced by Councilwoman McCarthy and seconded by
Councilman Paoloni.
WHEREAS, the Town Board of the Town of Wappinger has examined the sewer budget
for all sewer districts and sewer improvements within the Town of Wappinger for the
calendar year 2006; and
WHEREAS, a Public Hearing was held on the 9th day of January 2006 at 7:30 p.m. at the
Town Hall located at 20 Middlebush road, Wappingers Falls, New York; and
WHEREAS, all property owners within sewer districts or improvements, as well as
members of the public had an opportunity to voice their opinions regarding the
imposition of sewer rents; and
WHEREAS, the Town Board has authorized to establish sewer rents as prescribed
pursuant to Town Law 198.1 (i); and
WHEREAS, Article 14-F of the General Municipal Law authorizes sewer rents to be
established by resolution of the Town Board; and
WHEREAS, the Town Board hereby wishes to establish sewer rents for the various
sewer districts and sewer improvement areas in the Town.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby adopts the recitations and statements set forth above as if
fully set forth and resolved herein.
2. The Town Board hereby establishes and imposed sewer rents on all properties
located within the various sewer districts and sewer improvement areas as set
forth on the attached Schedule.
3. The sewer rents shall be billed and collected on a quarterly basis, in arrears,
retroactive to January 1,2006, which sewer rents shall be collected by the Receiver
of Taxes for the Town of Wappinger.

4. A surcharge of ten percent (10%) shall be imposed for sewer rents and remaining
unpaid for more than five (5) days after the due date.

The purpose of the local law is to amend Section 234-44.A of the Town of
Wappinger Code and to establish the water rate structure for the Central Water System for
the calendar year 2006. The Central Water System is comprised of the following districts,
which are hydraulically interconnected:
• Central Wappinger Water Improvement
• North Wappinger Water Improvement
• Myers Corners II Water District
• Cranberry Hills Water Improvement
Oakwood Water District
• Wappinger Parlc Water District & Extension
• Ardmore Hills Water Improvement Area; and

As presently drafted, §234-44.A requires rate changes for Water Districts and
Im rovements to be adopted by separate Local Law for each District or Improvement. The

Section III: 234.44.A shall he amended to read as follows:

The provisions of this Local Law are separable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any

not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this local law or their application to other persons or circumstances. It is hereby declared
to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law
would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence;
subsection, word or part had not been included therein, and if such person or circumstance to
which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.

Section I: Title:
This Local Law shall b

Section II• Legislative Intent:
The purpose ose of the local law is to further amend Section 234-44.A of the Town of
Wappinger Code by designating the Meadowood Water District as part of the Central Water
System because the Meadowood Water District is also hydraulically interconnected with the
other water districts and water improvements within the Central Water System. Specifically
the Central Water System is comprised of the following districts which are hydraulically
interconnected:

§234-44.A requires rate changes for Water Districts and Improvements to be
adopted by separate Local Law for each District or Improvement. The proposed
amendment permits the water rate to be set by one Local Law as well as to establish the new
rates for the other water districts and water improvements not contained within the Central
Water System for Calendar Year 2006.
Section III: 234.44.A shall he further amended to read as follows:

A Public Hearing was held by the Town Board of the Town of Wappinger on
January 9, 2006 at the Town Hall, 20 Middlebush Road, Wappingers Falls,
New York to hear objections Amending the Town of Wappinger Code
Establishing the Water Rate Structure for the Central Water System for the
year 2006.
A Public Hearing on Local Law Further Amending 234-44A of the Town
Code by Including the Meadowood Water District within the Central Water
System and Establishing the Water Rate Structure for the Fleetwood, Tall
Trees and Watch Hill Water Districts for 2006 and a Public Hearing for the
Sewer Rent Structure for Sewer Districts and Sewer Improvements for the
Calendar Year 2006.
Supervisor Ruggiero opened the meeting at 7:37 p.m.

The Town Clerk offered for the record, the Affidavits of Posting, Publication
and Mailing duly signed and notarized. (These Affidavits are attached hereto
and made part thereof the Minutes of this Hearing).
Supervisor Ruggiero announced that early last year was the first year of
operation for the Central Wappinger Water system where the Town fiscally
connected all it's Water districts together with project 99-2 (R). When the
Town created the 2005 Budget, the Town budgeted approximately $60,000 for
this project. During 2005, electric rates for the Town went from .09 cents per
kwh up to.15 per kwh for Commercial. This caused the budget prepared for
2005 to increase to $150,000, which exceeded the amount budgeted. This
increase must be passed on to the residents to cover those costs as outlined in
the letters sent to the homeowners. In 2005 the Town was able to use
$100,000 of Fund Balance, which is surplus money accrued in the water
district over the years, to help offset the cost. In 2006, there is only $79,000
available to apply to help reduce the rate.
At this time Supervisor Ruggiero turned the meeting over to Jay Paggi,
Engineer to the Town. Mr. Paggi went on to explain the amount of water
that was pumped over last year, the increase in electric costs and the
decrease in the amount of surplus budget funds that were available to apply

to the 2006 budget which caused a necessity to increase the budget to
approximately $775,000. With that in mind, the rate structure had to be
adjusted. An analysis was performed on the amount of water that was
utilized by residential customers and commercial customers. The proposed
rates are based on the funds necessary to operate the systems. There are
approximately 4,000 customers in the district which have to generate the
funds necessary to run the system. Mr. Paggi went on to answer residents
questions regarding what the increase costs would be in their water districts
and all the districts that make up the Central Water District. At this time,
Supervisor Ruggiero opened the floor for comments.
Rosemary Cummings of 35 Pye Lane wished to know whether she was paying
her water bill in gallons or cubic feet. She was told cubic feet. Since she
moved here, her bill has always been the same. What was the incentive to
conserve if she only used the minimum? She was told that if she was just
using the minimum she was conserving water. There would be more of an
increase to residents who were using over the minimum. The rates are set up
to encourage water conservation. She may not notice, because she is
conserving water.
Vic Margiotta of 5 Mina Drive was looking over the numbers and with a
family of four, figures his rate was going to increase about 70% a year. He
said the letter he received did not go into language that might be understood
by the average person.
Eileen Chadwick of 8 Amherst Lane was wondering why Tall Trees was going
up to $95. She was told the well system in Tall Trees was very weak, has
been on water restriction all year, and, because there were only 82 homes
water costs more. She wished to know if they could be hooked into the
Central Water System and was told it was just not economical at this time.
There were no further questions or comments.
Councilwoman McCarthy moved to close the Public Hearings, seconded by
Councilman Bettina and unanimously carried.
The Public Hearings closed at 8:00 pm.

A Public Hearing was held by the Town Board of the Town of Wappinger on
January 9, 2006 at the Town Hall, 20 Middlebush Road, Wappingers Falls,
New York on proposed Amendments to the Comprehensive Plan Regarding
Farmland Protection. Supervisor Ruggiero opened the meeting at 8:01 p.m.

The Town Clerk offered for the record, the Affidavits of Posting, Publication
and Mailing duly signed and notarized. (These Affidavits are attached hereto
and made part thereof the Minutes of this Hearing).
Supervisor Ruggiero explained that the Town of Wappinger is making an
application with the Town of Fishkill seeking Farmland Preservation
Protection monies to help preserve the Hobbit Farm on Chelsea Road. The
farm exists in the two municipalities and both towns have agreed to go in on
a joint application to seek funding. If awarded, we can expect to get 75%
from the State of New York and 25% would require a local match to purchase
the development rights from the sponsor to be ever protected.
Supervisor Ruggiero wished to know if there were any questions or
comments. There were none.
Councilman Bettina moved to close the Public Hearing, seconded by
Councilwoman McCarthy and unanimously carried.

A Public Hearing was held by the Town Board of the Town of Wappinger on January 9,
2006 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York to hear
Objections to the Assessment Rolls and Proposed Budgets for Special Improvement
Districts or Special Improvement Areas. Supervisor Ruggiero opened the meeting at
8:02 p.m.

The Town Clerk offered for the ,record, the Affidavits of Posting, Publication and Mailing
duly signed and notarized. (These Affidavits are attached hereto and made part thereof
the Minutes of this Hearing).
Supervisor Ruggiero announced that each year when the Town does the tax levy it has to
levy taxes for the Capital infrastructure for its water and sewer systems. This is the
money that goes toward paying down the Bond.
For the Fleetwood Water District for 2005, the benefit unit charge was $171.78 and in
2006 will go down to $165.38. In the Ardmore Water District there will be no benefit
unit charge because there is no existing debt. In the Central Wappinger Water District,
the benefit unit charge is $2.72 per unit and in 2006 will be zero. In the Wappinger
Cranberry Water System it was $9.27 per unit and in 2006 will be $8.92. Myers Corners
II Water System in 2005 was $513.per unit and in 2006 will be $500. North Wappinger
Water in 2005 was $6.87 per unit and in 2006 will be $7.48. Oakwood Water for 2005
was $135.31 and will be reduced to $128.26 in 2006. Tall Trees Water in 2005 was
$23.54 per unit and in 2006 $22.93. The Wappinger Park Water System in 2005 was
$227.69 per unit and in 2006 reduced to $217.81. Watch Hill Water System will have no
benefit unit charge as in 2005. Wappinger Emergency Area Improvement in 2005 was
$9.23 per unit and reduced to $9.10 in 2006. Wappinger Water Improvement Area 1999-
29 was $76.75 per unit in 2005 and will go up to $110.98 in 2006. Mid Point Sewer was
zero in 2005 and will remain zero in 2006. Rockingham Sewer was zero in 2005 and will
remain zero in 2006. Central Wappinger Sewer was $36.36 in 2005 and will be reduced
to $11.78 per unit in 2006. Wildwood Sewer is zero and will remain zero in 2006.
Wappinger Sewer Transmission Treatment #1 was $195.61 per unit in 2005 and has been
reduced 191.02 in 2006. Wappinger Sewer Transmission Treatment #2 was $58.40 per
unit in 2005 and will be increased to $58.47 in 2006. Watch Hill Sewer was $48.11 per
unit in 2005 and remained $48.11 in 2006. Wappinger Sewer Transmission Treatment
3A had a benefit charge of $458.61 in 2005 and will be reduced to $413.32 in 2006. Jay

Paggi, Engineer to the Town went on to explain how a benefit unit was determined. It
consists of one house on a lot of 2 acres or less regardless of the value of the home. If
you own a home in excess of two acres, the acreage is paid at the rate of .2 benefit units
per acre.
Supervisor Ruggiero wished to know if anyone from the audience had any questions or
comments in regard to the benefit units. There were none.
Councilman Bettina moved to close the Public Hearing, seconded by Councilwoman
McCarthy and unanimously carried.
The Public Hearing closed at 8:10 p.m.
