Craig O'Donnell was granted 2 variances for the side yard setback.

Dear Craig,
In reference to your application to construct an in ground swimming pool on
your property as stated above and further identified as Tax Map #
6057.04.553316, the application is denied at this time.
You are in an R80 Zoning district which requires a rear yard setback of fifty
feet. Your survey map dated July 29th, 1997 and prepared by Robert V.
Oswald LLS, shows a rear yard setback of 25.4 feet.
In addition, your house was constructed under Building Permit # 87-247. The
preliminary plot plan submitted, which was dated August 25th, 1987, and
prepared by Richard Barger P.E. &. L.S., did have a fifty foot rear yard
setback. However, the final as built, dated December 24th, 1987 and
prepared by Richard Barger shows the rear yard setback for your house to be
26.6 feet. The required setback is fifty feet.
On January 22, 1988 the engineer to the Town, Joseph Paggi, made written
notes on the plan that the rear setback must be accepted by the Zoning
Administrator. I can not find any record of Herb Levenson accepting this
setback prior to then Building Inspector Thomas Classey issuing the
Certificate of Occupancy for your residence.
You will have to make application to the Zoning Board of Appeals for two rear
yard variances, one for the house and one for the proposed swimming pool.
