TO: Mr. Michael DiZilla 75 Ketchamtown Road Wappinger Falls, NY 12590 Tax Grid No. 19-6157-03-205371-00 At the meeting of the Zoning Board of Appeals on 03/25/97, the referenced appeal was considered and the action indicated below was taken on your request for an interpretation of the Zoning Law. The Zoning Board of Appeals adopted the following resolution which states its interpretation of the Zoning Law as requested in your appeal. With reference to Article IT, Section 220, definitions -- which states an accessory apartment is to be located 'within the same building' as a permitted one family dwelling. The Zoning Administrator issued an interpretation that the above section meant that the applicant is not permitted to have an accessory apartment outside the footprint of the building. The applicant requests an interpretation of the Zoning Administrator's ruling. After a detailed discussion the Zoning Board of Appeals unanimously upheld the Zoning Administrator's interpretation.
