At the meeting of the Zon1ng Board of Appeals on 09/12/95, the referenced
appeal was considered and the action indicated below was taken on your
request for an area variance to the Town of Wappinger zoning Law.
By resolut1on of the Board, it was determIned that:
There is not suffIcient area available to the Appellant to satisfy
the the lot size reqllirement of 20,000 sq. ft. for an accessory apartment.
The Appellant can provide 19{819 sq. ft. which the Board feels is
suffIc1ent.
~L was further determined that:
(a) The requested variance w1ll not produce an undesirable change 1n
the character of the neighborhood.
(b) No substantial detriment will be created to nearby propert1es.
lc) There was no other feasible method available for you to purslle to
achieve the benefit you seek other than the requested variance.
(d) The requested area var1ance is not substantial.
{e) The proposed variance wIll not have an adverse effect or impact on
the physIcal or environmental conditions in the neighborhood or
d1strIct.
(f) The alleged dIfficulty was not self-created.
(g) The var1ance IS the minimum necessary to grant relief from your
(l.lfficulty.
CONCLUSION: Therefore, It was determined that the re. ed varIance be
granted, and that the previous deciSIon of the Enfqrcemen
reversed.
