At the meeting of the Zoning Board of Anneals on 09/12/95, the referenced
appeal was cons1dered and the action indicated below was taken on your
requesL for an area var1ance to the Town of Wappinger Zoning Law.
By resolut1on of the Board, it was determ1ned that:
There 18 not sufficient area ava1lable to the Appellant to sat1sfy
Lhe requ1rements that you are to maintain 50 ft. frontage, for each lot
mentioned above, on a town road.
The Appellant can provide for Lot =19-6156-02-624800-00 a 22 ft.
frontage and for Lot ~19-6156-02-616787-00 there is no frontage available
which the Board felt was suffic1ent;w1th the condition that the applicants
grant a 10 ft. easement on Lot ~19-6156-02-624800-00 that 15 10 ft. wide
by the length of walters Lane in favor of Lot #19-6156-02-616787-00.
Also, it was agreed that there would be one entrance for both lots on
Osborn Hill Road.
It was further determined that:
(al The requested variance w1ll not produce an undesirable change 1n
the character of the neighborhood.
(bl No substantial detriment will be created to nearby propertles.
(cl There was no other feasible method available for you to purslle to
achieve the benefit you seek other than the requested variance.
(d) The requested area varlance is not substantial.
te) The proposed variance will not have an adverse effect or lmpact on
the physical or environmental conditions in the neighborhood or
district.
(f) The alleged difflculty was not self-created.
(g) The variance is the minimum necessary to grant relief from your
difficulty.
CONCLUSION: Therefore. it was determined that theF- sted variance be
granted, and that the prevlous deelslon of the En oreem .t Off,cer b.
