The matter having duly come on to be heard before a duly convened meeting of the
Board on' the 8th day of November 1994 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject property is located in an R-40 area at 20 Vanderwater
Drive in the Town of Wappingerr. The Town of Wappinger Zoning Law
permits the storage of one each auto trailer, unoccupied recreational 0
vehicle, one boat or unregistered vehicle, provided effective screening
from the adjoining properties is provided andall minimum setbacks for
buildings are provided. .
The trailer in question is the rear half of a commercial tractor trailer
combination an d not allowed under the present Town of Wappinger Zoning
Law. Three adjoining ~roperty owners appeared at the public hearing to
testify against the granting of of the variance and to voice their
objections that ~he trailer is not screenrd from the adjoining properties,
detracts from the character of the neighborhood an d adversely affects
adjoing prperties. The applicant and his wife spoke in favor of granting
the variance stating that the trailer had existed for a con~iderable
time, that it was used by the applicant playing a musical instrument and
that prior approval for it's existence was g~anted by a previous town
official (unknown)). No recors documenting any approval can be found
in the Town of Wappinger reords or can be provided by the applicant.
The Board ha~ determined that the variance will be detrimental to nearby
properies as evidneced.by the owners of those properites objecting to the
variance; Even though it existed for a considerable time, an undesirable
change will occur in the character of the neighborhood as a result of it's
rusty an d deteriating appearance and lack of screening, that there is
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the (over)
application or appeal be and the same is hereby DENIED

The decision of the Zoning Administrator is hereby upheld
