The matter having duly come on to be heard before a duly convened meeting of the
Board on the 22nd day of June 1993 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the

The subject premises are located in SC District on the easterly side of Route 9
between Old Hopewell Road and Myers Corners Road in the Town of Wappinger, New York
designated as 1357 Route 9, Wappingers Falls, New York. The subject premises is a
new building being constructed by the Alpine Company of Poughkeepsie to house Stop
and Shop. Premises is one building within a shopping plaza known as Alpine Commons.
The applicant has applied to install the following signs on the face of the building.
A. ~top & Shop sign 5 ft. X 60 ft. 300 sq. ft.
B. Florist sign 2% ft. X 16 ft. 40 sq. ft.
C. Cheese Shop sign 2% ft. X 16 ft. 40 sq. ft.
D. Fish Market sign 2% ft. X 16 ft. 40 sq. ft.
E. General Store sign 2% ft. X 16 ft. 40 sq. ft.
F. Video Center sign 2% ft. X 16 ft. 40 sq. ft.
G. Pharmacy sign 2% ft. X 16 ft. 40 sq. ft.
H. Bake Shop sign 2% ft. X 16 ft. 40 sq. ft.
Total sq. ft. 580 sq. ft.
The application of Article IV, Section 416.64 of the Town of Wappinger Zoning Law
allows a total of 100 sq. ft.
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the
application or appeal be and the same is hereby granted
The decision of the Zoning Administrator is hereby reversed

Appiicant was formally denied by the Zoning Administrator and is seeking a variance
of 480 ft.
The applicant has applied for a second variance of Article IV, Section 416.65
rega~ding dimensio~:of signs whereas, the Stop & Shop sign is proposed to be 5
foot' high where 3 foot height is allowed, requiring a 2 foot variance.
The board heard testimony from Mr. Edward Kellogg.of the Alpine ~
Companies that the signs are not visible from Route 9 or other areas except1ng the
rear portions of other commercial properties and no undesirable change will be
produced in the character of the neighborhood. That the variance is minimal in
nature and affects no other properties.That the difficulty was not self created and
is created by the topography of the land and the location of the building as a result
of that topography.
The Zoning Board of Appeals has declared themselves Lead Agency, and has declared a
Negative Delcaration. Although the variance is substantial in nature it will be
mitigated by the fact that signs will not be seen externally until the customers
enter the parking lot of the plaza and that quick location and identification will
be beneficial in promoting safety and that the benefit cannot be obtained by any
other feasible method other than a variance.
