The matter having duly come on to be heard before a duly convened meeting of the
Board on the 24th day of May, 1994 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

By resolution of the Board, it was determined that:
There is not sufficient area available to the appellant to satisfy the requirement
of 50 feet of frontage on a town road.
It was further determined that the appellant has a legal building lot located on a
right of way and that the granting of the variance will not increase the number of
building lots on the right of way.
It was further determined that the Zoning Board of Appeals is following its own
precedent in that a variance was granted to a prior applicant on the same right-
of~ay previously under the same set of circumstances.
It was further determined that:
(a) The requested variance will not produce an un~esirable change in the
characted of the neighborhood as the right-of~ay currently has several single
family houses on lots of similar or larger size.

(b) No substantial detriment will be created to nearby properties. All of those
in attendance at the public hearing spoke in favor of granting the variance and all
speaking were residents on the right-of~ay. The deed to the property contains a
provision that the appellant will become a participant of a written agreement to
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the
application or appeal be and the same is hereby granted
The decision of the Zoning Administrator is herebYreversed
