PAOLONI ROBERT L. VALDATI 05/09/2005.WS The Workshop Meeting of the Town of Wappinger was held on May 9, 2005, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Ruggiero opened the meeting at 7:30 p.m. Present: Joseph Ruggiero, Supervisor Vincent Bettina, Councilman Maureen McCarthy, Councilwoman Joseph Paoloni, Councilman Gloria J. Morse, Town Clerk Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the Town Graham Foster, Highway Superintendent David Stolman, Town Planner Absent: Robert Valdati, Councilman SUSPENSION OF RULES FOR PUBLIC COMMENT ON AGENDA ITEMS Councilwoman McCarthy moved to suspend the rules for public comment on Agenda Items, seconded by Councilman Paoloni and unanimously carried. John Ragusa of 183 Riverview Drive was in favor of the proposed Local Law placing Stop Signs at Flint Rock and Riverview Roads for the safety of the children. Rick Dahl of 187 Riverview Drive was also in favor of the Stop Signs. Mr. Dahl delivered a signed petition to the Town Clerk in favor of the Stop Signs. Councilman Paoloni moved to reinstate the rules, seconded by Councilwoman McCarthy and unanimously carried. DISCUSSIONS: • Wetlands Ordinance — David Stolman went over a draft of the Wetlands Law which with included changes of the proposed amendments for the Town Boards review. • Accessory Apartments — Councilman Bettina announced that a study performed by AARP strongly supports accessory apartments be made available to seniors 62 and over. This would expand the supply of affordable housing for both owner and renter in the community. He would also like the issue of family members to be addressed. We owe an obligation to our seniors. Discussion followed. David Stolman went over a draft which would change the existing regulation for accessory apartments be processed by the Zoning Administrator and Building Inspector rather than the Planning Board. Other changes 1 05/09/2005.WS would include: the elimination of a minimum lot size requirement; allowing accessory apartments in accessory buildings; lifting prohibition against accessory apartments in principal dwellings that already contain boarders, a home occupation, or a professional home office; and adjustments and clarifications to various requirements including dwelling unit size, access and parking. Discussion followed. • Lot Line Realignment Applications — David Stolman went over draft amendments to Section 217.12.H of the Town's Subdivisions Regulation that would permit the Planning Board to waive the public hearing for subdivisions that consist solely of a lot line realignment between two adjacent lots. • Stop Sign at Flint Rock & River View Drive- Graham Foster announced that he and Jay Paggi, Engineer to the Town were both in agreement that this is a suitable place for a Stop Sign. RESOLUTIONS: RESOLUTION NO. 063-2005 RESOLUTION INTRODUCING LOCAL LAW NO. OF THE YEAR 2005, DESIGNATING A FULL STOP INTERSECTION AT THE INTERSECTION OF FLINTROCK ROAD AND RIVERVIEW DRIVE The following resolution was introduced by Councilman Bettina and seconded by Councilman Paoloni. WHEREAS, Town Engineer, Joseph E. Paggi, Jr., by letter dated April 21, 2005, has recommended that the Town install a "stop sign" and establish a full stop intersection at Flintrock Road at its eastbound intersection with Riverview Drive; and WHEREAS, Highway Superintendent, Graham Foster, by letter dated April 21, 2005, has approved the installation of a "stop sign" and the establishment of a full stop intersection at Flintrock Road at its eastbound intersection with Riverview Drive; and WHEREAS, the Town Board has elected to create a full stop intersection at Flintrock Road at its eastbound intersection with Riverview Drive; and WHEREAS, the Town Board, in accordance with the recommendation of Town Engineer, Joseph E. Paggi, Jr., and the approval of Highway Superintendent, Graham Foster, directs the placement of the "stop sign" on Flintrock Road as it intersects with Riverview Drive; and WHEREAS, this is a Type II action pursuant to 6 NYCRR 617.5 (c) (20) and is otherwise exempt from environmental review pursuant to the New York State Environmental Review Act (SEQRA) or pursuant to Local Law No. 6 of 1992. 2 05/09/2005.WS NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby introduces for adoption Local Law No._ of 2005 in the form annexed hereto. 3. The Town Board hereby determines that the enactment of the aforementioned Local Law is a Type II action as defined in 6 NYCRR 617.5 (c) (20) and, accordingly, the Town Board hereby expressly determines that this action is not an action that requires review pursuant to the provisions of New York State Environmental Review Act (SEQRA) or pursuant to Local Law No. 6 of 1992 or pursuant to 6 NYCRR Parts (17). 4. The Town Board hereby schedules a Public Hearing on the Proposed Adoption of Local Law No. _ of the Year 2005 to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 13th day of June, 2005, at 7:30 p.m., and that the Town Clerk be directed to post and publish Notice of the Public Hearing in the form annexed hereto. The foregoing was put to a vote which resulted as follows: Joseph Ruggiero, Supervisor Voting Aye Robert Valdati, Councilman Voting Absent Vincent Bettina, Councilman Voting Aye Joseph Paoloni, Councilman Voting Aye Maureen McCarthy, Councilwoman Voting Aye The Resolution is hereby duly declared adopted. NEW BUSINESS/COMMENTS Councilman Bettina requests the Town Board to consider the necessity of senior housing. That type of program is endorsed by the AARP. There is a need for this type of housing in our area which would allow the seniors to live in the community. Supervisor Ruggiero asked Mr. Stolman to review the documents that were brought in tonight by Councilman Bettina and report back. Councilman Bettina moved to rename the Old Dormitory Building located at Carnwath to, Frances Reese Cultural Center, seconded by Councilwoman McCarthy and unanimously carried. There was no other business to come before the Board. Councilman Bettina moved to close the meeting, seconded by Councilwoman McCarthy and unanimously carried.
