Date of Advertisement: July 14, 1993 Southern dutchess News Date of Public Hearing:July 19,1993 Place of Hearing: Town Hall, 20 Middlebush Road, Wappingers Falls, New York MEMBERS PRESENT: DONALD KELLER WILLIAM PARSONS PHilIP DINONNO HUGO MUSTO CHAIRMAN VICE CHAIRMAN MEMBER MEMBER MICHAEL FRANZESE CHRIS SIMONETTY JOHN PERILLO MEMBER MEMBER MEMBER\.BSENT The matter having duly come on to be heard before a duly convened meeting of the Planning Board on the 19THday of JULY 1993 and all facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered, and due deliberation having been had, the following are the: FINDINGS OF FACT: THE OWNERS MUST COMPLY WITH ALL THE CONDITIONS AND STIPULATIONS OF SECTION 445 AS AMENDED OF THE TOWN OF WAPPINGER ZONING LAW AND THE NEW YORK UNIFORM FIRE PREVENTION AND BUILDING CODES. A SHORT EAF HAS BEEN SUBMITTED AS PER SEQRA REQUIREMENTS AND A NEGATIVE DECLARATION IS IN ORDER SINCE IT APPEARS THAT THERE WILL BE NO MAJOR IMPACT ON THE ENVIRONMENT. THEREFORE, based upon the findings of fact it is hereby ordered, granted subject to: (I) Compliance with all conditions and stipulations of Section 445 as amended, Town of Wappinger Zoning Law and the New York State Uniform Fire Prevention and Building Codes: (2) The required smoke alarms/heat detectors shall not be battery ope73ted and must be connected to the existing electrical system and approved by the Bureau of Fire Under- writers: (3) The applicant shall obtain a building permit within 180 days of the date of the signing of this SPECIAL USE PERMIT, by the Town Clerk: (4) Substantial completion within twelve (12) months of the date of the issuance of the building permit: (5) The Zoning Administrator will do an inspection of the above premises every year on the anniversary date of this SPECIAL USE PERMIT and: (6) A Certificate of Occupancy must be issued within two (2) years of the date of the issuance of the building permit, otherwise this SPECIAL USE PERMIT will become null and void: (7) If title passes a new Special Use Permit must be applied for. THEREFORE, based upon the above findings of fact, it is hereby ORDERED that the application be and the same is hereby: GRANTED This Special Use Permit is granted for a period of 2 year (s) and maybe renewed every 2 year thereafter.
