Date of Advertisement: October 14, 1992 - Southern Dutchess News Date of Public Hearing: October 20, 1992 Place of Hearing: Town Hall, 20 Middlebush Road, Wappingers Falls, New York MEMBERS PRESENT: Mr. Sasser Chairman Mr. Hirkala Vice'Chairman Mr. Lehigh Member The matter having duly come on to be heard before a duly convened meeting of the Board on'the 20th day of October, 1992 and the:facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: Mr. Brooker Mr. Bitterlich Member Member The subject premises is located in the HD district with ,the fol!owing setback requirements, Front: 75 feet, Side: 10 feet Rear: 20 feet, on property located on Route 9 Between Myers Corners Road and Old Hopewell Road, which is a New York State' Highway. The Zoning Board had received comments from Mr. Raymond Arnold, Planner to the Planning Board relative to this same type of business indicating supp~rt of variance. The Planning Board of the Town of Wappinger is Lead Agency and a short EAF has been submitted to satisfy SEQRA. There will be no major impacts on the environment. The Board has determined that the variance will not change the character of the locality; the degree of the variance sought is minimal; and that the effect on the physical ana environmental conditions of the locality will be enhanced by the granting of this variance. The Board has further considered ,altermative methods and self created difficulty and has weighed the evidence presented and found in favor of granting the variance on those grounds.
