Date of Public Hearing: May 12, 1992 Place of Hearing: Town Hall, 20 Middlebush Road, Wappingers Falls, New York MEMBERS PRESENT: Chairman Mr. Hirkala Vice Chairman Mr. Lehigh Member The matter having duly come on to be heard before a duly convened meeting of the Board on' the 12th day of May, 1992 and the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: Mr. Bitterlich Member Member The subject premises are located in the R-40/80 District with the following setbacks requirements: Front: 50'; Side: 40'; Rear 50'; on Diddell Road which is a Town Road. The applicants have satisfied this Board of the need for this garage, and the Board feels the criteria for an area variance have been met. A practical difficulty exists and such difficulyt cannot be obviated by a method other than a variance. There will not be a sustantial change in the character of the neighborhook. This action will not be detrimental to adjoining properties. The character of the neighborhood will be preserved/ This is a minimum variance that will provide refief. A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is in order since it appears that there will be no major impact on the environment. THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the application or appeal be and the same is hereby: GRANTED, subject to: No part of the garage will be used as living space and the Zoning Administrator.will'make an annual inspection of the premises to verify compliance with this Decision & Order. , The decision of the Zoning Administrator is hereby REVERSED.
