The ~atter having duly come on to be heard before a duly convened meeting of the
Board on' the 28th day of January, 1992 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:
The subject premises is located in the R-I0 district with following setback requirements
Front 40'; Side 5'; RearS'; on Sececa Lane which is a Town Road. There was a pre-existing
above gound pool, without benefit of a variance or building permit. The applicants have
satisfied the Board of the need for this variance, and the Board feels that the criteria
for a area variance have been met. A practical difficulty exists and such difficulty
cannot be obviated by a methodlother than a variance. This will not be detrimental to
adjoining properties. The character of the neighborhood will be perserved. This is the
minimum variance that will provide relief. A short EAF has been submitted as per SEQRA
requirements and a Negative Declaration is in order since it appears that there will be
no major impact on the environment.

THEREFORE, based upon the finding of fact, it is hereby ORDERED, that the application
or appeal be and the same is hereby GRANTED, subject to:
1. That a building permit be applied for.
2. If at any time the pool is moved, it must be placed to conform with the current
Zoning setback~. \
THEREFORE,based upon the finding of fact, it is her~~y ORDERED, that the
application or appeal be and the same is hereby GRANTED.

The decision of the Zoning Administrator is hereby REVERSED.
