The matter having duly come on to be heard before a duly convened meeting of the
Board on" the 11th day of August, 1992 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premises is located at 10 Stage Door Road, Wappinger Falls, New York.
The building which is a retail furniture store including furniture warehouse space
and office space consists of 18,971 square feet of retail space, 10,484 square feet
of warehouse space and 547 square feet of office space which requires 140 parking
spaces. The applicant has requested a reduction of parking spaces to 50. The
evidence submitted in conjuction with the application includingITEParkfng studies
and recommendations by the Planner to the Planning Board and the Engineer to the
Town of Wappinger together with their recommendations of approval of this request
has. caused the Board to determine that the granting of the variance would not change
the character of the locality, that the site does not permit alternative methods to
achieve and that the degree of the variance is minimal. It has further determined that
while the situation may be self created, that does not automatically deny the granting
of the variance.
A Short form EAF"has been submitted as required by SEQRA and the Board adopted a

Negative Declaration.
THEREFORE, based upon the findings of fact it is hereby ORDERED, that the application
or appeal be the same is hereby Granted subject to the following conditions and/or
restrictions: (1) That the landscaping to be provided and as shown on the map dated
.July 15, 1992 will be at a minimum equal to or comparable to that shown (2) That
no parking shall be allowed along Stage Door Road and that (3) The approval is
limited to retail furniture sales, warehousing of furniture and office use associated
with retail and warehousing of furniture and shall not be applicable to any other
use.
THEREFORE, based upon the Findings of Fact, it is hereby ORDERED, that the application
or appeal be and the same is hereby GRANTED
