The matter having duly come on to be heard before a duly convened meeting of the
Board on' the 14th day of July, 1992 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premises is located in the R-20 district with the following setback
requirements, Front 35 feet; Side 20 feet; Rear 40 feet. Accessory structures must
maintain 10 foot side yard and rear yards on Robert Lane which is a town road. An
above ground swimming pool has existed on the property in excess of twelve years
without the benefit of building permit or variance. a short form EAF has been submitted
as required by SEQRA and the Board adopted a Negative Declaration as there is no
major impact on the environment. The Board has determined that the granting of
the variance will not change the character of locality, there are no reasonable
al~ernative methods to achieve the variance; the degree of the variance is mini~al,
the physical and environmental conditions of the area require the pool to be located
in it's present condition and the problem is not self created as the property was
purchased with the pool in tact. The Board finds that the evidence presented and
considered requires the granting of teh variance on these grounds.
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the
application or appeal be and the same is hereby GRANTED, subject to:
1. That a building permit be applied for.
2. If at any time the plIo is moved, it must be placed to conform with the current
Zoning setbacks.

The decision of the Zoning Administrator is hereby REVERSED
