The matter having duly come on to be heard before a duly convened meeting of the
Board on' the 11th day of August, 1992 and the:-facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premises is located in the R-20 district ~ith the fdllowing set backs:
Front 60 feet; Side 20 feet; Rear 40 feet; on Old State 'Road, wHich is a Town Road.
The proposed addition will not conform to the sideline setback requirements. However
a practical difficulty exists and such difficulty cannot be obviqted by a method
other then a variance. This action will not be detrimental to the adjoining properties.
The character of the neighborhood will be preserved. This is th~minimum variance that
will provide relief.
A shprt EAF has been submitted as per SEQRA requirements and a Negative Declaration
is in order since it appears that there will be no major impact on the environment.
THEREFORE, based upon the above findings of fact, it is hereby ORDERED that the
application or appeal be and the same is hereby GRANTED, subject to: (1) The
applicant shall obtain a Building Permit within 180 days from the date 'of the signing
of this Decision 'and Order by the Town Clerk; (2) Substantial completion within 12
months of the date of the issuance of the Building Pe~it ,and (3) a Certificate of
Occupancy must be issued within two years of the date of the issuance of the Building
Permit, otherwise this Decision and Order will be Null and Void.
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the
application or appeal be and the same is hereby GRANTED
