Y. 12590 Grid No. /1 6257-02-910632 Zone: R-20 9 feet for the construction of a garage Section 421 Date of Advertisement: July 29, 1992 - Southern'Dutchess News Date of Public Hearing: August 11, 1992 - Adjourned re-opened August 25, 1992 Place of Hearing: Town Hall, 20 Middlebush Road, Wappingers Falls, New York MEMBERS PRESENT: Joel Sasser Chairman Michael Hirkala Vice' Chairman Al Lehigh Member The matter having duly come on to be heard before a duly convened meeting of the Board on' the 25 day of August, 1992 and the:facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: James Brooker William Bitterlich Member Member , The subject premises is located in the R-20 district .with the following set backs: Front 60 feet; Side 20 feet; Rear 40 feet on 7 Scott Drive which is a Town Road. The proposed addition will not conform to the side setback requirements. The action cannot be practically obviated in a manner other than a variance. This yariance will not be detrimental to the adjoining properties. The character of the neighborhoo9 will be preserved. This is the minimum variance that will provide relief. A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is ~n order since it appears that there will. be no major impact on the environment. THEREFORE based upon the above findings of fact, it is hereby ORDERED that the applicat or appeal be and the same is hereby GRANTED, subject to (1) That the existing walkway from the front of the property to the rear be removed from the right side of the property to the left and; (2) That if the tree on the right side of the property is removed that it De replaced with a similar type (not pecessarily mature size) tree and; (3) The applicant shall obtain a building permit within 180 days from the date of the signing of this Decision and Order by the Town Clerk and; (4) A Certificate of ~ccupancy must be' issued within two years of the date of the issuance of the building permit or this Decision and Order shall be null and void.
