The matter having duly come on to be heard before a duly convened meeting of the Board on' the 13 day of August, 1991 and the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: Mr. Brooker Member Member The subject premises are located in the R-I0 District with the following setback accessory building less than 15 feet in height. The applicants have satisfied the Board of the need for this garage and the Board feels the criteria for and area variance have been met. A practical difficulty exists and such difficulty cannot be obviated by a method other than a variance. There will not be a substantial change in the character of the neighbothood. This action will not be detrimental to adjoining properties. The character of the neighborhood will be preserved. This is a minimum variance that will provid~ relief. A short EAF has been submitted as per SEQR requirements and a negative declaration is in order since it appears that there will be no major impact on the environment. . THEREFORE, based upon the finding of fact, it is hereby ORDERED that the application or appeal be and the same is hereby GRANTED subject to: No part of the garage will b~ used as living space and the Zoning Administrator will make an annual inspection of the premises to verify' compliance with this Decision & Order. \ THEREFORE,based upon the finding of fact, it is her.eby ORDERED, that the application or appeal be and the same is hereby GRANTED.
