'Chairman Mrs. Roe Member The ~atter having duly come on to be heard before a duly convened meeting of the Board on' the 28th day of January, 1992 and the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: Mr. Lehigh Mr. Brooker Member Member The subject premises is located in the CC district with the following setback requirements. Front 75'; Side, North 40', Side, South 10' Rear 30'; on Route 9D which is ~ State Road. The applicant is adding additions to the North and South sides of an existing building, therefore requiring a 22.6 Variance on the North side and a 17.1 foot variance on the South side of. the existing bu~lding, since you are required to maintain a 75' frontage. The applicant has satisfied the Board of the need for the variance,' and the Board feels that the criteria for an area variance has been met. A practical difficulty exists and such a difficulty cannot. be obviated by a method other than a variance. This will not be det~imental to adjoining properties. The character of the neighborhood will be preserved. This is the minimum variance that will provide relief. A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is in.order since it appears that there ~ill be no major impact on the environment. THEREFORE,based upon the finding of fact, it is her~by ORDERED, that the application or appeal be and the same is hereby GRANTED , The decision of the Zoning Administrator is hereby REVERSED.
