The applicant has requested a 12.46 foot variance due to the fact that the neighbors driveway is enfringing on the above requirement, and this' situation has existed for over 30 years. A practical difficulty exists and such difficulty cannot be obviated by a method other than a variance. There will be no \ substantial change in the character of the neighborhood. This action will not be detrimental to adjoining properties. This is a minimum variance that will provide relief. A short EAF has been submitted as per SEQRA requirements, and a Negative Declaration is in order, since it appears that there will be no major impact on the environment. THEREFORE,based upon the finding of fact, it is her.eby ORDERED, that the application or appeal be and the same is hereby GRANTED The decision of the Zoning Administrator is hereby: REVERSED.
