The matter having duly come on to be heard before a duly convened meeting of the
Board on' the 22 day of October, 1991 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject property is located in an R-20 District, with the following requirement
Width: 100 feet. The applicant has requested a 12.46 foot variance due to the fact
that the neighbors driveway is enfringing on the above requirement, and this'
situation has existed for over 30 years. A practical difficulty exists and such
difficulty cannot be obviated by a method other than a variance. There will be no
\
substantial change in the character of the neighborhood. This action will not be
detrimental to adjoining properties. This is a minimum variance that will provide
relief.
A short EAF has been submitted as per SEQRA requirements, and a Negative Declaration
is in order, since it appears that there will be no major impact on the environment.
THEREFORE,based upon the finding of fact, it is her.eby ORDERED, that the
application or appeal be and the same is hereby GRANTED
The decision of the Zoning Administrator is hereby: REVERSED.
