Date of Advertisement: May 8, 1991 Southern Dutchess News Date of Public Hearing: May 28, 1991 Place of Hearing: Town Hall, 20 Middlebush Road, Wappingers Falls, New York MEMBERS PRESENT: Mr. Hirkala Chairman Mr. Lehigh Vice Chairman Mr. Sasser Member The matter having duly come on to be heard before a duly convened meeting of the Board on' the 28th day of May, 1991 and the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: Mrs. Roe Mr. Brooker Member Member The subject premises are located in the R-20 District with the following setback. requirements: Front - 60 feet; Side - 20 feet; and Rear - 40 feet on Schnabl Court which is a Town Road. The applicants have satisfied the Board of the need for this addition and the Board feels the criteria for an area variance have been met. A practical difficulty exists and such difficulty cannot be obviated by a method other than a variance. There will not be a substantial change in the character of the neighborhook. This action will not be detrimental to adjoining properties. The character of the neighborhood will be preserved. This is a minimum variance that will provide relief. A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is in order since it appears that there will be no major impact on the environment. - THEREFORE, based upon the Finding of Fact, it is hereby ORDERED that the application or appeal be and the same is hereby GRANTED subject to: 1) The applicants shall obtain a Building Permit witqin 180 day from the date of the signing of this Decision and Order by the Town Clerk; 2) Substantial completion within 12 mon~hs of the date of the issuance of the Building Permit and 3) ACertificate of Occupancy must be issued within two years of the date of the issuance of the Building Permit, otherwise this Decision and Order will be Null and Void.
