The matter having duly come on to be heard before a duly convened meeting of; the Planning
Board on the 6 . day of May and all facts, matters and evidence produced by the applicant,.
the Zoning Administrator and interested parties having been duly heard, rece.ived and
considered, and due deliberation having been had, the following are the
FINDING OF FACT:
The owners must comply with all the conditions and stipulations of Section 445 as amended
of the Town of Wappinger Zoning Ordinance and the New York Uniform Fire Prevention and . ,.
Building Codes. ,i'
A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is in,
order since it appears that there will be no major inpact on the enviorment.
THEREFORE, Based upon the above Findings of Fact it is hereby ordered, grant;i~d subject to;:
1. Compliance with all conditions and stipulations of Section 445 as amendedl, Town of I
Wappinger Zoning Ordinance and the New York Uniform Fire Prevention and B~ilding Codes:.

2. The required smoke alarms/heat detectors shall not be battery operated a~ must be
connected to the existing electrical system and approved by the Bureau of: Fire Underwriter
3. The applicants shall obtain a building permit within 180 days of the date: of the signing
of the Decision and Order by the Town Clerk. 'i
4. Sub~tantial completion within twelve (12) months of the date of the issua~ce of the
buiiding permit. . . ,f
5~ The Zoning Administrator will do.an inspection of the a~ove premises every year on the
'. i. anniversary date of this Decision and Order.
6. A Certificate of Occupancy must be issued within Two (2); years of the dat~ of the
issuance of the building permit, otherwis'e this Decision' and Order will biecome null
and void. 7. The owners Must file a Declaration of Covenants at the Dutc~ess County
Clerks office in favor of the Town of Wappinger per Sec~ion 445.5
THEREFORE, based upon the above findings of fact, it is hereby ORDERED
