Date of Advertisement: 9-11-91 Southern Dutchess News Date of Public Rearing: 9-24-91 Place of Rearing: Town Rall, 20 Middlebush Road, Wappingers Falls, New York MEMBERS PRESENT: Mr. Hirkala Chairman Mr. Lehigh Vice Chairman Mr. Sasser Member The ~atter having duly come on to be heard before a duly convened meeting of the Board on the 24th day of September 1991 and the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: The subject premises is located in the R-40 district with the following setbacks Front: 75 feet; Side: 25 feet; Rear 50 feet; on Brothers Road which is a Town Road. The proposed addition will not conform to the sideline setback requirements. However a practical difficulty exists and such a difficulty cannot be obviated by a metqos other then a variance. This action will not be detrimental to the adjoining properties. The character of the neighborhood will be preserved. This is the minimum variance that will provide relief. Mr. Brooker Mrs. Roe Member Member A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is in order since it appears ,that there will be no major impact on the envirorment. THEREFORE, based upon the above findings of fact, it is hereby ORDERED that the application or appeal be and the same is hereby GRANTED subject to 1)_ The applicants shall obtain a Building-Permit within 180 days from the date of the signing of this DECISION and ORDER by the Town Clerk; 2) Substantial completion within 12 months of the date ,of the issuance of the Building Permi~ and; 3) a Certif~cate of Occupancy must be issued within two years of the date of the issuance of the Building Permit, of her wise this DECISION and ORDER will be NULL and VOID.
