The ~atter having duly come on to be heard before a duly convened meeting of the
Board on the 24th day of Sept. 1991 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premise is located in the GB district with the following set backs:
Front: 75 feet, Sied: 20 feet, Rear: 30 Feet on Route 376 with is a State Road. The
applicant is adding an addition to his existing building and needs a 29 foot fro~t variance.
A practical difficulty exists and such difficulty cannot be obviated by a method other then
a variance. Therefore based on ~he response from the D.O.T. that there will be no impact
on the neighborhood this variance is hereby Granted. This is the minimum variance that
will provide relief.
A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is in
order since it appears that there will be no major impact on the envirorment.
THEREFORE,' based upon the above findings of fact, it is hereby Ordered that the application
or appeal be and the same is hereby GRANTED, subject to: 1) The applicant shall obtgin a
building permit within 180 days from the date of the signing of this Decision and Order by
the Town Clerk. 2) 'Substantial complelion within 12 months of the date of the issuance of
the Building Permit and 3) a Certificate of Occupancy ~ust be issued within two years of
the date of the issuance of the Building Permit, otherwise this Decision and Order will be
Null and Void.
THEREFORE,based upon the finding of fact, it is her~by ORDERED, that the
application or appeal be and the same is hereby GRANTED
The decision of the Zoning Administrator is hereby: REVERSED
