The matter having duly come on to be heard before a duly convened meeting of the
Board on the 25 day of Sept, 1990 and the fact:, matters and :videnc:
produced by the applicant, the Zoning Administrator and ~nterested part~es hav~ng
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premises is located in the R-20 district with the
following set back requirements Front 10 feet; sides 10 feet; rear 10; on Kent Road which
is a Town Road, the applicant has constructed~,chalet type shed back in 1966 without the
benefit of a building permit for the proposed. The applicants have satified the'Board
of the need for this shed and the Board feels the criteria for an Area Variance Have
been met. A practical difficulty exists and such difficulty cannot be obviated by a method
other than a variance. There will'not be~substantial change in the character of the
neighborhOod. This action will not be detrimental to adjoining properties. The character
of the neighborhood will be preserved. This is the minimum variance that will provide relief.
A short EAF has Deen submitted as per SEQR requirements and a negative declaration is
in order since it appears that there will be no major impact on the environment.
