Board on'the 17th day of April 1990 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premises is located in the HB-2A district with the following setback
requirements: Front-100; Sides 50; Transportation Road. The applicants are,proposing
to build an office building and it would be a considerable difficulty financially
to created an independent driveway. The applicants have satisfied the board of the need
for this variance. A practicaf difficulty exists and such difficulty cannot be obviated
by a method other than a variance. There will not be a substancial 'change in the
character of the neighborhood. This action will not be detrimental to adjoining
properties. The character of the neighborhood will be preserved. This is the minimum
var~ance that Mill provide relief. A short ,EAF has been submitted as per SEQR '
requirements, and a negative declaration is in the order since it appears there will be
no major impact on the Environment.
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the
application or appeal be and the same is hereby GRANtED subject to the following conditions.
(1) BGHKR REALTY INC, SHALL PROVIDE DECELERATION AND ACCELERATION LANES'AT THE INGRESS ,AND
EGRESS ON ROUTE #9.
(2) BGHKR REALTY INC. SHALL RESPOND IN FULL TO THE DEPARTMENT OF TANSPORTATION LETTER DATED
