The matter having duly come on to be heard before a duly convened meeting of the
Board oil,the 25 day of Sept, 1990 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and intereste~ parties having
been duly heard, received and considered and due deliberation hav~ng been had, the
following are the
FINDINGS OF FACT: The subject premises is located in the R-20 district with the following
set backs Front 60 Feet; Side 20; Rear 40; on Namoth Road which is a Town Road.'
This parcel is a part of Edgehill III SUBDIVISION AND was average density in 1966 by the
Planning Board of the Town of Wappinger. On the filed map in the County Clerks'Office.
The proposed addition will not conform to the sideline setback requirements. However a
practical difficulty exists and such difficulty cannot be obviated by a method other then
a variance. This action will not! be detrimental to the adjoining properties. The character
of the neighborborhood will be preserved. This is the minimum variance that will provide
relief.
A short EAF Has been submitted as per SEQRA requiements and a negative declaration is
in order since it appears that there will be no major impact on the envirorment.

Therefore, based upon the above findings of fact, it is hereby ORDERED that the
application or app~al be and the same1is hereby GRANTED, subject to: 1) The applicants
shall obtain a Building Permit within 180 days from th~ date of the signing of this
Decision and Order by the Town Clerk; 2) Substantial completion within 12 months of the
date of the,issuance of the Building Permit and 3) a Certificate of Occupancy must be
issued within two years of the date of the issuance of the Building Permit, otherwise
this Decision and Order will'be Null and Void.
