The matter having duly come on to be heard before a duly convened meeting of the
Board on'the 8th day of May 1990 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject property is located in the R-20 district with the following setbacks; front
75', sideyard 20', rear 401; on Peggy Lane which is a toWn road. The applicants have
satisfied the board of the need for this garage and the board feels they have met the
criteria for a variance. A practical difficulty exists and such difficulty cannot be
obviated by a method other than a variance there will not be a substancial change in

the character of the neighborhood. This action will not be detrimental to adjoining
properties. The character of the neighborhood will be preserved. This is the
minimum variance that will provide relief. A short EAF has been submitted as per SEQR
req4irements and a negative declaration is ~n order since it appears that there will
be no major impact on the enviornment.
THEREFORE,based upon the finding of fact, it is her~by ORDERED, that the
application or appeal be and the same is hereby GRANTED (1) The applicant will pick up a
building permit within 180 days and substantial construction will be completed within
one (1) year and (2) A certificate of occupancy will be issued within two (2) years of the
date of this order.
The decision of the Zoning Administrator is hereby
REVERSED
