The matter having duly corne on to be heard before a duly convened meeting of
the Board on the 18 day of Dec. 199<and all facts, matters and evidence
produced by the applicant,' the Zoning Administrator and inte~ested. partie~
having been ,duly heard, received and considered, and due del1berat1on hav1ng
been had, the following are~the
fINDING OF FACT:
The owners must comply with all the conditions and stipulations of Section 445 as amended
of the Town of Wappinger Zoning Ordinance'and the New York Uniform Fire Prevention and
Building Codes.
A short EAF has been submitted as per SEQR requirements and a negative declaration is in
order since it appears tha tthere will be no major inpact on the enviorment.
Therefore, based upon the above findings of fact it is hereby ordered, granted subject to:
(1) Compliance with all conditions and stipulations of Section 445 as amended, Town of
Wappinger Zoning Ordinance and the New York State Uniform Fire Prevention and the Building
Code: (2) The required smoke alarms/ heat detectors shall not be battery operated and must be
connected to the existing electrical system and approved by the Bureau of Fire Underwriters
(3) The applicants shall obtain a building permit within 180 days of the date of the signing
of the decision and order by the Town Clerk: (4) Substantial completion within twelve (12)
months of the date of tQe issuance of the building permit: (5) The Zoning Administrator will de
an inspection of athe above premised every year on the anniversary date of this decision and
order and: (6) A Certificate of Occupancy must be issued within two (2) years of the date of
the issuance of the building permit, otherwise this decision and order will become null and
void.
THEREFORE, based upon the above findings of fact, 'it is hereby ORDERED-E:naf
the application or appeal be and the same is hereby Granted
This Special Use Permit is granted for a period 2 years and may be renewed
every 2 year thereafter.
