The matter having duly come on to be heard before a duly convened meeting of the
Board on' the 24th day of July 1990 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had the
following are the '
FINDINGS OF FACT:

The applicant has requested a Special Use Permit in accordance with Article IV Section
430 and Article 422 Section 6 in order to erect a 4500 square foot building, to store
truck tires and conduct an interior service for tire repair only.

A.public hearing was held and the Zoning Board of Appeals finds the criteria set down
in Section 430 - Special Use Permits of the Town of Wappinger Zoning ~Ordinance has
been met with the following conditions.
A short EAF has been submitted as per requirements, and a negative declaration is in
order since it appears that there will be no major impact of the Environment:
Therefore based upon the findings of facts, it is hereby ordered that the application
be and the same is hereby granted for a special use permit subject to the following

All tires and rims to be stored inside.
There shall be no lubrication or oil changes permitted on the entire site.
There shall be no trucks of vehicles parked on the siRht overni~ht.
All servicing of tire ie tire changing shall be done within the building.
There shall be an annual inspection by the Zoning Administrator and the Fire
Inspector of the Town of Wappinger.

The building and the site shall be built in conformity with the NYS Fire and
Building Code as required.
