The matter having duly come on to be heard before a duly convened meeting of the
Board on' the 28th day of March, 1989 and the facts, matters and evidence
produced by the applicant, the Zoning Adm~nistrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subjected premises are located in the R-40 district with the
following setback requirements; front 50 feet, sides 25 feet, rear
50 feet, on Larissa Lane.
The applicant produced a letter from Dr. Thomas S. R.obinson, MD,
supporting practical difficulties and hardsh~p substantiating ~he
request for a Special Use Permit, under Sect10n 445 of the Zon1ng
Ordinance of the Town of Wappinger.
. Therefore, ~ased upon the above findings of fact it is hereby ordered,
granted subject to: (I) Compliance with all conditions and stipulations of
Section 445 as amended, Town of Wappinger; Zoning Ordinance and the New York
State Uniform Fire Prevention and Building Code: (2)The required smoke
alarrns/heat detectors shall not'be battery operated and must be connected
to the existing electrical system and approved by the Bureau of Fire Under-
writers: (3)The applicants shall obtain a building permit within 180 days
of the date of the signing of this decision, and order by the Town Clerk:
(4) Substantial completion within twelve (12) months of the date of the
issuance of the building permit: (5)The Zoning Administrator will do an
inspection.of the above premises every year on the anniversary date of this
decision and order and: (6)A certificate of 'Occupancy must be issued within
two (2) years of the date of the issuance of the building permit, otherwise
this decision and order will become null and void.
The decision of the Zoning Administrator is hereby
