Appeal #1072 G1"1d No./I'19-6257-02-559936-00 Zone: R-20 on tltre Date of Advertisement: October 18, 1989 Date of Public Rearing: October 24 1989 Place of Rearing: Town RaIl, 20 Midd~ebush Road, Wappingers Falls, New York MEMBERS PRESENT: James Brooker Chairman James Tompkins Vice Chairman Michael H~rkala Member The matter having duly come on to be heard before a duly convened meeting of the Board on the day of and the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: The subject premises are located in the R-20 district with the following setbacks: front 75'; sideyard 20'; rear 40'; on Baldwin Drive in the "Ye Old Apple Orchard Subdivision." The applicants have owned this parcel of land since 1977. The applicants have satisfied the board of the need for this variance, and the board feels the criteria for an area variance has been met. A practical difficulty exists and such difficulty cannot be obviated by a method other than a' variance. There will not be a substantial change in the character of the neighborhood. This action will not be detrimental to the adjoining properties. The character of the neighborhood will be preserved. This is a minimum variance that will provide relief. A short EAF has been submitted as per SEQRA requirements and a negative declaration is ,in order since ,it appears that there will be no major impact on the environment.
