Vice Chairman Alberta Roe Member The matter having duly come on to be heard before a duly convened meeting of the Board on'the 28th day of November, 198~nd the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had~ the following are the FINDINGS OF FACT: Alan Lehigh Member Member ': : I The subject premises are located in the HB-2A District with the following setbacks: front 50': sideya'rd 10': rear yard 30': on Old Rte. 9, which is a town road, and Route 9 which is a state road. The applicant has a double faced lighted sign marked "Marco's", which is off site from Marcos Restaurant. The applicant has satisfied the practical difficulty and the hardship aspect of the zoning requirements. A short EAF has been submitted as per SEQRA requirements, and a Negative Declaration is in order since it appears that there will be no major impact on the environment. There, based upon the above findings of fact, it is hereby ordered that the application for a Special Use Permit be, and the same is hereby granted subject to the following conditions: 1. Premises will be subject to an annual inspection. 2. If premises are sold, the Special Use Permit will be null and void. 3. The sign configuration cannot be changed without the consent of the zoning Board of Appeals.
