The matter having duly come on to be heard before a duly convened meeting of the
Board on' the 28th day of March, 1989 and the fact.s, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premises are located in the R-40 District with the
following setback requirements; front 50 feet, sides 25 feet, rear
50', on Johnston Place.
The applicant is requesting a variance for road frontage under Section
280A of the Town Law, on a road which is Johnston Place, that is not a
Town dedicated road.
The applicant, at the Public Hearing, failed to prove practical
difficulty or any hardship with regard to the above request.
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the
application or appeal be and the same is hereby denied.
The decision of the Zoning Administrator is hereby upheld
