The matter having duly come on to be heard before a duly convened meeting of the
Board on the 28th day of March, 1989 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subjected premises are located in the R-20 zone with the "
following setback requirements; front 35 feet, sides 20 feet, rear 40 feet, :
on Sky top Drive.
The applicant is requesting a variance of the required road frontage
of 35 I to erect a screened in porch that wi.ll require an 8 foot front yard
variance. He explained his practical difficulty and the board granted
the variance subject to the following conditions;
1. The applicant shall obtain a building permit within 180 days of the
signing of this decision and order by the Town Clerk;
2. Substantial completion within twelve (12) months of the date of the
issuance of t~e building permit.
3. A certificate of occupancy must be issued within two (2) years of the
date of the issuance of the building permit, otherwise this decision and
order will become null & void.
4. The porch shall remain screened and cannot be closed for any other
purpose without first coming to the Zoning Board of Appeals, Town of
Wappinger.
THEREFORE,based upon the finding of fact, it is hereby ORDERED, that the
application or appeal be and the same is hereby granted.
The decision of the Zoning Administrator is hereby reversed.
