'; ; I MEMBERS PRESENT: James Brooker Chairman James Tompkins Vice Chairman Michael H~rkala Member The matter having duly come on to be heard before a duly convened meeting of the Board on'the 20th day of September 89 and the facts, matters and evidence produced by the applicant, the Zoning Administrator and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: The applicant has requested a Special Use Permit in accordance with Article IV, Section 430, and Article'422, Paragraph 6, in order to operate motor vehicle sales, repair & service,in a fully enclosed structure. After the public hearings that were held, where many adjojning property owners voiced their concerns, the Zoping Board of Appeals finds the criteria set down in Section 430-Special Use Permits of the Town of Wappinger Zoning Ordinance have been met with the following' conditions: Alberta Roe Alan Lehigh Member Member A short EAF has been submitted as per SEQRA requirements and a Negative Declaration is in order since it appears that there will be no major impact on the environment. THEREFORE, based upon the following findings of fact, it is hereby ordered, that the application be, and the same is hereby granted for a Special Use Permit subject to: 1. There will be no car washing at anytime 2. There will be mo outside microphones or horns 3. There will be no horn blowing on the premises at anytime. 4. There will be an annual inspection of said premises by the Zoning Adm. and Fire Inspector. 5. Landscaping buffer on the south side of parcel will be Douglas Fir, placed as per the approved site plan. 6. All windows to the south will be shielded from adjoining property owners.
