The matter having duly come on to be heard before a duly convened meeting of the
Board on'the 25th day of July 1989 and the facts, matters and evidence
produced by the applicant, the Zoning Adm~nistrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:
The applicant has requested a Special Use Permit in accordance with
Article IV, Section 430 and Article 422, Paragraph 7, in order to
convert a two (2) bay garage into a recyclable, fully automatic
car wash.

After the public hearings that were ~eld, where many adjoining property
owners voiced there concerns, the Zoning Board of Appeals finds the
criteria set down in Section 430-Special Use Permits of Town of
Wappinger Zoning Ordinance have been met with the following
conditions:
A short EAF has been submitted as per SEQRA requiremen~p,and a Negative
Declaration is in order since it appears that there will be no major
impact on the environment.
THEREFORE, based upon the above findings of fact, it is hereby ordered
that the application be, and the same is hereby Granted, for a Special
Use Permit subject to:
1. All bulk water requirements are to be trucked on to the site. No
start up water is to be drawn from the Town water system.
2. All used water used in the car wash is to be retained in proper
holding tanks and to be trucked off the premises and disposed of as per
DEC rules & regulat1ons. (see other side)
The decision of the Zoning Administrator is hereby r' eversed.

3. There is to be no residual water on exit way to DeGarmo Hills Road
or on DeGarmo Hills Road during the winter months that can cause a hazard.
4. There will be no automotive repair permit on these premises.
5. There will be no commercial parking day or night on these premises.
6. There will only be one (1) sign permitted on these premises per the Town
of Wappinger Zoning Ordinance.
7. The entire site shall conform to all the requirements of the Zoning
Ordinance of the Town of Wappinger.
8. There shall only be a snack bar and there shall be no coffee or sand-
wiches, milk sold on the above premises.
9. There will be semi-annual inspections of these premises to see to it that
the site is i~ conformity at all times.
10. There will^~O stacking of cars awaiting car wash off of the site.
11. There will be erected a slotted chain link fence to properly shield the
car wash from adjoining property owners prior to Certificate of Occupancy
and Special Use Permit is issued.
12. There will be a zero discharge of water on these premises at all times.
