The matter having duly come on to be heard before a duly convened meeting of the
Board on the 12 day of April, 1988 and the facts, matters and evidence
produced by the applicant, the Zoning Administrator and interested parties having
been duly heard, received and considered and due deliberation having been had, the
following are the
FINDINGS OF FACT:

The subject premises are located in the R-80 District with the following setback requirements
Front -75'; Sides 40'; Rear 50'; on Smithtown Road which is a Town Road. The applicant has
satisfied the Zoning Board of Appeals of the need for this variance. A practical, difficulty
exists and such difficulty cannot be obviated by a method other than a variance. There will
not be a substantial change in ~he character of the neighborhood. This action will not be
detrimental to the adjoining properties. This is a minimal variance that will provide relief.
THEREFORE, based upon the findings of fact it is hereby ORDERED the the application or appeal
be, and the same is hereby, Granted subject t.o:
1. That a sprinkler system be placed in the residence. Approved by the Fire Prevention Bureau.
and the Building Inspector, and copies of approved plan be forwarded to this Board.
2. That a 500 foot blacktop apron be \installed on the driveway.

3. That all concerns of the Engineer to the Town be fully completed prior to the issuance
of a Certificate of Occupancy.

Based on Letters received from Mr. Kyle pottenburgh, Chief of the Department of the New
Hackensack Fire District, Memo from Mr. Jay paggi, Towri Engineer, and Building Inspector
Tim Classy. The above Members of the Zoning Board of Appeals have voted to With Draw
Decision and Order dated April 12, 1988.
THEREFORE, based upon the New Findings of Fact it is hereby ORDERED that the application
or appeal be, and the same is hereby GRANTED subject to:
1. That a Sprinkler system be placed in the residence. This has been done and has been
'approved by the the FIRE Prevention Bureau and the Building Inspector. Letters on file.
2. All foncerns of the Engineer to the Town have been fully completed Letter on file.
Therefore a Certificate of Occupancy can be issued.
THEREFORE,based upon the finding of fact, it is her~by ORDERED, that the
