FINDINGS 01' TAC!:
The subject premises are located in the R-40 district with the fol-
lowing setback requirements: Front 75ft.; sides 25ft.; rear 50ft.; on Rte.
376, which is a state road. The Applicant has satisfied the board of the
need for this open deck and the board feels the criteria for an area var-
iance have been met. A practical difficulty exists and such difficulty
cannot be obviated by a method other than a variance. There will not be a
substantial change in the character of the neighborhood. This action will
not be detrimental to adjoining properties. The character of the neigh-
borhood will be preserved. This is a minimum variance that will provide
relief.

A short EAF has been submitted as per SEQR requirements and a neg-
ative declaration is in order since it appears that there will be no
major impact on the environmemt.
Therefore, based upon the above findings of facts it is hereby ordered
that the appl~ationor appeal be,and the same granted subject to: 1.The
applicant shall obtain a building permit within six months (180 days)of the
date of the signing of this decision and order by the Town Clerk; 2.Sub-
stantial completion within 12 months of the date of issuance of the build-
ing permit; 3.Subject to the recommendation of the Fire Prevention Bureau
in that a modern alarm system is utilized and installed. 4.Subject to letter
of approvalr~eived from the Federal Aviation Administration~ 5.A Certifi-
cate of Occupancy must be issued within two (2) years of the date of the
issuance of the building permit, otherwise this decision and order will be
