The ma~er having duly come on ~o be heard before a duly conveyed meeting of ~he Board
on "the 23rd day of June, 1987 and ~he facts, ma~~ers and evidence produced by
the applican~, ~be Zoning 1nspec~or and in~eres~ed par~ies bav~ng been duly heard,
,received and considered and due deliberation baving been bad, the follo~~g are ~be
T!NDINGS or FACT:
the premises is located in an R-80 district with the following setback requirements:
Front 75 feet; sides 40 feet; rear 50 feet on Osborne Hill.Road which is a County Road.
The applicant is making the above request because he had difficulty with the builder
wherein he never completed the building of his deck. Subsequently, he completed same. The
applicant has satisfied the Board of the need fpr this open w90d deck and feels that the
criteria for a variance have been met. A p~actical difficulty exists and the difficulty
~annot be obtained be a-method other than by variance. ' There will not be a s~bstantial
change in the character of the neighborhood. Thi-s action will not be detrimental to the
adjoining properties. The character of the neighborhood will be preserved. This is a
minimum variance that will provide relief. A short EAF has been submitted as per SEQR
requirements and a negative declaration is in order since it appears there will be no
imp~ct on the environment.
~~O~, based upon the.finding of fact, it is hereby ORDERED, that the application
or appeal be and the same is hereby GRANTED subject to the deck remaining open unless
application to enlcose is made to and approved by the Zoning Board of Appeals.
