The subject premises are located in the R-20 District with the following setback requirements:
Front - 60 feet; Side - 20 feet; Rear - 40 feet on Chelsea Road which is a Town Road.
The applicant has satisfied the Board of the need for this solar unit and the Board feels
the criterra for an area variance have been met. A practical difficulty exists and such
difficulty cannot be obviated by a method other than a variance. There will not be a
substantial change in the character of the neighborhood~ This action will not be
detrimental to the aqjoining properties. The character of the neighborhood will be
preserved, Th~s minimum variance will provide relief.

A short EAF has been submitted as per SEQR requirements and a negative delaration is in
order since it appears that there will be no major impact on the environment.
~~z:O?Z, based upon the finding of fact, it is hereby ORDERED, that the application
or appeal be and the same is hereby'GRANTED subject to the solar unit maintain a 6'3"
setback and that the greenhouse will always remain the same and not become part of an
enclosed structure of the house~
