The subject premises is in the R-20 District with the following setback requirements:
Fr9nt _ 60 feet; Side - 20 feet; and Rear - 40 feet on Old Hopewell Road which is a
County Road. The applicant is proposing the construction of a single dwelling unit
measuring 1-,012 squ~re feet. The house is properly spotted on the survey and meets all
the setback requirements. The Board feels tha~ this construction will enhance the
neighborhood considerably. A practical difficulty exists and such .difficulty cannot
be obviated by a method-other than a variance. There will not be a substantial "change
"in the character of 'the neighborhood. This action will not be detrimental to adjoining
pro~erties. The character of the neighborhood will be preserved. This is a minimum
variance that will provide relief.
A short EAF has been submitted as per SEQR.requirements and a negative declaration is
in order since it appears that there will be no major impact on the environment.
:i::..:.rZ:0?~, based upon the finding. of fact, it is hereby ORDERED that the application or "
appeal be and the same is hereby GRANTED subject to the following conditions: (1) Prior
to the issuance of a permanent Certificate of Occupancy the structure will be demolished'
and the County has to verify that they are in full approv.al of the curb cuts. (2) The
applicant has agreed to not conduct any retail business in the frontof the new house to
the road:because of the fact that is a residential area and a non-conforming use.
(3) The Zoning Administrator can inspect all the prem~ses to assure compliance with the
Zoning Ordinance and the variance conditions.
